Refusing to “woodenly perpetuate the national tragedy surrounding quick foreclosures,” a Brooklyn judge has ordered a bank and a tenant to split the difference in a $1,000-per-month gap in a proposed loan modification to avoid foreclosure.

The defendant, Everton Dudley, asked to pay $2,000 a month to keep his Brooklyn home, while the lender, Aames Funding Corporation, was willing to accept a minimum monthly payment of $3,000.
