ALBANY – A judge who asked potential jurors to step aside after they indicated by a show of hands that they thought they had conflicts that would disqualify them from serving erred by not immediately inquiring further about the specifics of those conflicts, an appeals court has determined.

The Appellate Division, Third Department, unanimously ordered a new trial for Thomas Roblee on assault charges in People v. Roblee, 101960.

The Third Department decision appears on page 42 of the print edition of today’s Law Journal.
