Important changes have recently taken place that will affect every lawyer who practices before the U.S. Court of Appeals for the Second Circuit. On Jan. 1, 2010, after a seven-week comment period, new local rules for the court took effect. The revised and renumbered rules—which are available on the court’s newly designed Webpage at http://www.ca2.uscourts.gov/clerk/Rules/Rules_home.htm—are extensive and affect such matters as appeal docketing requirements, motions for extending the time to file briefs, briefing schedules, and oral argument procedures. They also announce new guidelines consistent with the court’s conversion, on Jan. 20, 2010, to a new case management and electronic document filing system (CM/ECF).
While, in many instances, the rules contain new standards and procedures, unfortunately, there is no official commentary to explain the reasons for the revisions or how they are meant to work in practice. This article will examine some of the principal revisions, focusing on those of particular importance to practitioners.
