Employees may invoke an implied covenant of good faith to defeat contractual provisions barring them from collecting previously earned commissions after they have left their companies, a unanimous panel has ruled.

The ruling in Arbeeny v. Kennedy Executive Search,105733/07, gives a headhunter a shot at recovering $224,000 he claims to have earned in commissions before he was fired after 15 months on the job.
