Litigation, as we have known it, is undergoing rapid change and will continue to do so. I will focus on the areas in which I foresee the greatest changes and assess how these changes affect the bench and the bar: (1) jurisdiction; (2) pleading standards and case tracking; (3) vanishing trials and the changing jury culture; (4) alternative dispute resolution; and (5) the impact of electronic communications on civil and criminal litigation.
