Governor David A. Paterson has designated two officials to fill the top-level law enforcement posts that opened with the resignation of Denise E. O’Donnell on Feb. 25. Mary B. Kavaney has been appointed deputy secretary for public safety while Sean M. Byrne was designated acting commissioner of the Division of Criminal Justice Services (DCJS). Ms. O’Donnell held both titles before her abrupt departure over Mr. Paterson’s intervention in the case of a woman who said she had been beaten up by Paterson aide David Johnson (NYLJ, Feb. 26). Deputies for public safety are responsible for oversight of the state police, the state prison system and other law enforcement agencies.

Ms. Kavaney, previously Ms. O’Donnell’s top assistant, was also the agency’s attorney in charge of the Poughkeepsie office and an assistant district attorney in Orange County. Mr. Byrne, a founder of the New York Prosecutors Training Institute, has been executive deputy commissioner at DCJS since 2007. He was also once law clerk to Court of Appeals Judge Joseph W. Bellacosa. Mr. Byrne’s appointment is subject to state Senate confirmation; Ms. Kavaney’s is not. – Joel Stashenko
