A Long Island woman facing vehicular homicide charges who was pregnant at the time of a 2008 fatal car accident cannot be prosecuted for the subsequent death of her newborn, a state judge has ruled.
In a pretrial decision last week, Justice C. Randall Hinrichs of Suffolk County (See Profile) refused to dismiss the most serious counts against Jennifer Jorgensen, including aggravated vehicular homicide and second-degree manslaughter. But he ruled that “the facts alleged and accepted as true here cannot result in conviction” for endangering a fetus.
