In a recent editorial in The New York Times, President Barack Obama was praised for his decision to hold the trial of Kalid Shaikh Mohammed and his co-conspirators in the federal court in lower Manhattan.1 The Times stated that the trial in “rigged military courts” would be “legally wrong, and hugely damaging to American values and this country’s global image.” However, the article went on to presume guilt when it stated that these “mass murderers” ought to be tried in “our backyard.” It is for this very reason that the case should not be tried in New York.2

The presidential spokesman, Robert Gibbs, stated at a press conference televised by CNN that Kalid Shaikh Mohammed will “be brought to justice and he is likely to be executed for the heinous crimes he committed.”3 It was reported that in 2007, Kalid Shaikh Mohammed at a hearing in Guantánamo Bay, testified: “I was responsible for the 9/11 operation from A to Z.” It would be unduly burdensome to recite all the references, all of which agreed that Mohammed is guilty of planning the 9/11 bombing and disaster.
