ALBANY – Gamblers seeking to offset huge portions of their losses through deductions on New York state taxes are out of luck.

The Tax Appeals Tribunal has ruled that a state tax statute that significantly limits total itemized deductions when a taxpayer’s adjusted gross income exceeds $100,000 does not unconstitutionally discriminate against taxpayers who suffer large income gains or losses through gambling.
