A woman whose ex-husband has been in and out of jail since 2003 and has a history of alcohol abuse, can leave the state with the parties’ 9-year-old son, even though she had signed a custody order barring her from moving more than 25 miles without giving 90-days notice.
“M.M.H.,” a nurse who earns roughly $60,000 a year and whose house is in foreclosure, argued that relocating to North Carolina, where her parents reside, would lead to a significant improvement in her financial condition and enable her to spend more time with her son.
