ALBANY – The “Moxie Mania” computerized betting game the state initially authorized for installation in some 500 taverns throughout New York is a game of chance and not of skill and therefore illegal under New York’s anti-gambling statutes, a state appeals court ruled last week.
The Liquor Authority did not abuse its discretion when in November 2008 it reversed an earlier opinion of the authority’s counsel and decided that the Moxie Mania Empire Edition game represented an impermissible form of casino gaming that is illegal in New York, the Appellate Division, Third Department, ruled unanimously.
