A Manhattan judge has cleared the way for trial in a legal malpractice case stemming from a law firm’s representation of a prominent personal injury attorney who was convicted nearly two decades ago of using fraudulent evidence in tort cases against New York City.
Supreme Court Justice Alice Schlesinger (See Profile) last week denied competing motions for summary judgment in the long-running suit against LaRossa, Mitchell & Ross brought by a successor to Morris J. Eisen PC, which had been a client of LaRossa Mitchell. The decision comes nearly two years after the New York Court of Appeals revived the suit, which had been dismissed because the Eisen firm was in dissolution.
