A co-op or condominium board may wish to enhance the safety of building occupants by installing security cameras in common areas. A board’s permission may also be sought by apartment owners who wish to install security cameras in common corridors or outside apartment entrance doors. Both issues require a board to address two questions: does the board have the legal authority to do so and, if so, what procedures should the board follow? Further, are there countervailing concerns a board should consider, such as the privacy of occupants.
This column discusses relevant case law and statutes, provides guidance to boards and managers as to whether and where security cameras may be installed and suggests methods to protect the privacy of occupants and employees.
