A sharply divided appeals court yesterday narrowly interpreted a state Court of Appeals ruling setting standards for when expert testimony on eyewitness identifications is required.
In doing so, the Appellate Division, First Department, affirmed in People v. Santiago, 551/03, the conviction of a homeless man for slashing a college co-ed on a subway platform with a box cutter.
