The Attorney General’s Office has declined to appear before a Long Island village justice to defend a state law that prevented the justice from appointing counsel for an 18-year-old facing 15 days in jail for a serious traffic offense.

Westbury Village Justice Thomas Liotti had scheduled a June 11 hearing to consider the constitutionality of Article 18-B of the County Law, which guarantees free legal assistance to indigent defendants charged with felonies or misdemeanors—although not to those like Stanley Louisseize, who are charged with violations or traffic infractions.
