Bernstein and Boris Segalis, associates at the firm, write: The Bankruptcy Code establishes a direct link between the quality of a company's privacy notice and the value of personal information collected pursuant to the notice. A strategic approach to maintaining the value of personal information assets and mitigating against the restrictions ombudsmen and bankruptcy courts may impose on sales or leases of personal information assets requires companies to implement comprehensive and robust privacy notices that anticipate changes in their business circumstances.
