A mistrial has been declared in a heavily litigated malpractice case against Proskauer Rose after a six-week trial in Palm Beach Circuit Court. The mistrial was declared late last week after jurors were divided after three days of deliberation. A retrial is expected early next year, said Boca Raton attorney Steven Katzman of Katzman Wasserman Bennardini & Rubinstein, which represented plaintiff Boca Aviation. “It’s unfortunate we were only able to convince four out of the six jurors,” Mr. Katzman said. “I have no reason to believe a settlement will happen because Proskauer has been unwilling to accept responsibility and make reasonable settlement proposals.”
Proskauer issued a statement saying, “The attempt by Boca Aviation to transform its continued lack of success in court into a favorable press event is without basis.”
