A police officer who arrested a man for violating a loitering statute that was still on the books even though it was held unconstitutional almost two decades ago is entitled to qualified immunity from suit, a federal appeals court has ruled.

Joseph Amore sued Ithaca Officer Andrew Novarro after being charged with violating a law prohibiting loitering in a public place for the purpose of engaging in “deviant sexual” activity.
