A unanimous appeals panel in Manhattan yesterday upheld a lower court injunction barring New York City from proceeding with a plan to phase out 19 intermediate and high schools.

In an unsigned opinion, the Appellate Division, First Department, in Mulgrew v. Board of Education, 101352/10, ruled that Manhattan Justice Joan B. Lobis (See Profile) correctly issued the injunction because the city’s Department of Education had failed to comply with a 2009 law requiring it to compile “educational impact statements” before closing schools.
