The keen division over the constitutionality of New York’s Persistent Felony Offender Statute captivated the full U.S. Court of Appeals for the Second Circuit on Friday.

Twelve judges heard nearly two hours of argument on whether the state law violates the Sixth Amendment right to trial by jury because judges find facts that can increase the range of a defendant’s prison sentence.
