A Bronx judge Wednesday denied a motion to dismiss a lawsuit brought by the United Federation of Teachers and several advocacy groups, including the state chapter of the NAACP, complaining that the city has failed to properly spend hundreds of millions of dollars in state aid that have been earmarked for class-size reduction.

Justice John A. Barone rebuffed the New York City Department of Education’s claim that the lawsuit was barred because a statutory provision placed exclusive jurisdiction over the dispute in the hands of New York State Education Commissioner David M. Steiner.
