A former Epstein Becker & Green partner who sued the law firm over his capital contribution in California state court will have to arbitrate the dispute. Southern District Judge Laura Taylor Swain granted Epstein Becker’s motion to compel arbitration for claims initiated by Thomas Brown, an attorney who left the law firm in 2006. Mr. Brown, an employment lawyer, sued Epstein Becker in April in Los Angeles Superior Court. He alleged that the law firm committed fraud and balked on an agreement to return his capital contribution when he quit. He was a partner at the firm from 1991 to 2006.
Now a partner at Brown Gitt Law Group in Pasadena, Calif., Mr. Brown alleged that Epstein Becker unlawfully induced him to sign over portions of his paycheck as capital contribution. His lawsuit seeks $150,000 in capital reimbursements and punitive damages. Mr. Brown filed an arbitration action against the firm in California in March and filed his California state lawsuit in April. He then requested that the American Arbitration Action dismiss the arbitration proceeding. Epstein Becker petitioned a state trial court in New York to compel arbitration. The case was removed to federal court in June.
