A police officer hit by a drunken driver cannot bring a negligence action against the rental company that leased the pickup truck involved in the incident, a Dutchess County judge has ruled.

In dismissing Richard Poluzzi’s suit against Enterprise Rent a Car Company, Acting Supreme Court Justice Charles D. Wood (See Profile) held that the rental company, which checked Miguel Mojica’s license and had no knowledge that he previously had been convicted of driving while impaired, had no obligation to perform a more extensive background check into Mr. Mojica’s driving history.
