Michael J. Novack will retire as clerk of the Appellate Division, Third Department, on Nov. 23, and Deputy Clerk Robert D. Mayberger has been chosen to succeed him. Mr. Novack has been clerk to the Albany court since 1983, the same year Mr. Mayberger became deputy clerk. Mr. Novack, 63, said the court system’s early retirement incentive program was “one of the things that caused me” to step down. He joined the Third Department in 1972 and served as chief motion clerk, chief appellate court attorney and deputy clerk before becoming clerk under former Presiding Justice A. Franklin Mahoney.
Mr. Novack’s departure will leave all four Appellate Division departments with new clerks since Patricia L. Morgan became Fourth Department clerk in April 2009, replacing Jo Ann Wahl, who retired. Matthew G. Kiernan took over as Second Department clerk in April from Edward Pelzer, who also retired. And David Spokony, First Department clerk, has announced his retirement effective next month.
