A state judge has refused to order that the name of a Long Island genetic mother appear on a child’s birth certificate rather than that of the longtime friend who voluntarily acted as a surrogate and carried the baby girl to term.

Given state law against surrogacy contracts, Supreme Court Justice Peter Fox Cohalan (See Profile) in Suffolk County ruled that adoption was the only way for Elaine B. Feigenbaum to gain the status of the child’s legal mother.
