Attorneys appearing pro se to defend themselves against the collection of interest on past due taxes cannot recover prevailing party attorney’s fees from the United States, the U.S. Court of Appeals for the Second Circuit has ruled.

Addressing an issue of first impression, the Second Circuit said that lawyers who represent themselves and win in administrative or court proceedings against the federal government are ineligible for attorney’s fees under §7430 of the Internal Revenue Code.
