BOSTON – The U.S. Court of Appeals for the First Circuit has ruled that a Massachusetts transit police officer’s search of an occupied van, prompted by a suspicion of terrorism, was reasonable and does not disqualify evidence for the defendant’s crime of transporting illegal aliens.
The circuit’s unanimous Dec. 17 ruling in United States v. Ramos, 09/2251, affirmed the district court’s denial of defendant Edgar Ramos’ motion to suppress the evidence from the search.
