More than 400 plaintiffs who had their claims dismissed because they could not be found or refused to respond to correspondence from their lawyers have until Jan. 30 to seek reinstatement of respiratory and other claims associated with the response and cleanup of the World Trade Center terror attack.
Southern District Judge Alvin K. Hellerstein said in an order issued Thursday that despite the “numerous efforts” by plaintiffs’ lawyers and special counsel Michael Hoenig of Herzfeld & Rubin to contact the remaining plaintiffs, 409 “have failed purposefully and intentionally to prosecute their cases,” and are now dismissed from the litigation.
