The Torts, Insurance and Compensation Law (TICL) Section is comprised of attorneys devoted to examining substantive areas of law relating to torts, insurance and Workers’ Compensation. Presently, TICL is reviewing the statutory and regulatory framework relating to Medicare set-asides (MSA).
The purpose of the review is to examine and explore the current framework facing practitioners grappling with MSAs. After reviewing the current status of the legislation as well as how the Centers for Medicare and Medicaid (CMS) implements, evaluates and processes such cases, a task force will report its findings and issue recommendations for improvements of the system.
