Henry Matyjewicz, a.k.a. Poster Boy, will not have to spend a year in jail after all, the Appellate Division, Second Department, panel ruled in a unanimous opinion released Friday that sent the case back to a new judge.

Mr. Matyjewicz, who got his moniker by slicing and re-pasting subway ads to create new images and messages, had pleaded guilty to vandalizing subway ads in late 2009. Under the terms of the deal, if he completed 210 hours of community service, he would be sentenced to three years probation and the felony charge would be dropped.
