A state judge will hear arguments on Feb. 18 on whether to grant an order temporarily staying the control of Nassau County’s finances by a state-appointed oversight board. One day after the county filed a lawsuit seeking to annul a decision by the Nassau County Interim Finance Authority to take control of its finances, attorneys for both sides entered a stipulation scheduling the submission of court papers and oral arguments in the case. County officials filed an Article 78 lawsuit in Supreme Court yesterday alleging, among other things, that the authority did not meet statutory “triggers” justifying a control period.

With Supreme Court Justice Arthur M. Diamond (See Profile) presiding, William M. Savino of Rivkin Radler in Uniondale represented Nassau County, and Christopher J. Gunther of Skadden, Arps, Slate, Meagher & Flom appeared on behalf of the authority. In its Jan. 26 decision to take control of the county’s finances, the authority directed officials to submit a revised 2011 fiscal plan by Feb. 15, but yesterday’s stipulation pushes the deadline back to Feb. 22. — Andrew Keshner
