A disagreement between Boies, Schiller & Flexner and an ex-client over who should arbitrate a $5 million fee dispute resulted yesterday in a New York state judge naming an arbitrator that neither party had proposed.
Manhattan Supreme Court Justice Bernard J. Fried ( See Profile) appointed former Court of Appeals Judge George Bundy Smith as arbitrator in the fee dispute between the law firm and G.K. Las Vegas Limited Partnership, whom the firm represented in a Nevada lawsuit. The company has claimed that Boies Schiller “shirked its professional responsibilities” and that name partner David Boies neglected its suit.
