A municipal court judge who tried a burglary case without a prosecutor, declined to appoint a public defender and allegedly committed other procedural flubs is being taken to task in an appeal in Union County’s Superior Court.

Defendant Wendell Kirkland also claims Linden Municipal Court Judge Louis DiLeo allowed a police witness to cross-examine him and carried on his own questioning in a way that indicated a bias for the state.
