The two law professors whose $5.1 million defamation verdict against West Publishing was recently reduced to just $400,000 have won the right to take an immediate appeal.

In a three-page order handed down Wednesday in Rudovsky v. West Publishing Corp. , Senior U.S. District Judge John P. Fullam agreed to reconsider using the method of remittitur in deciding to reduce the verdict. Remittitur is a procedure that forces plaintiffs to choose between accepting the reduced verdict or a new trial.
