About a month before the U.S. Supreme Court heard arguments on whether a federal court may hear a nationwide class action on behalf of hundreds of thousands of female Wal-Mart employees,1 the U.S. District Court for the Western District of New York rejected class certification in a case where employees claimed that the enforcement of their employer’s uniform, nationwide policies violated overtime provisions in the Fair Labor Standards Act and various state wage and hour laws.

A dispute over the ownership of Facebook will remain in the Western District after the court denied a motion to remand. The court also addressed issues related to the practice of allowing motions for reconsideration in criminal matters despite the fact that the Federal Rules of Criminal Procedure do not expressly provide for such motions.
