A federal judge in Brooklyn has been ordered to narrow injunctions imposed on two out-of-state gun retailers barring them from violating New York City gun control laws on the grounds that the injunctions were overly vague. At the same time, the U.S. Court of Appeals for the Second Circuit affirmed parts of the injunctions requiring the retailers to be monitored by a special master.
The case, City of New York v. Mickalis Pawn Shop, 08-4804 and 09-1345, centered on whether the two stores could appeal a default judgment entered against them after they withdrew from the case before Eastern District Judge Jack B. Weinstein when their motions to dismiss for lack of personal jurisdiction were denied.
