A man whose Ferrari has been impounded since his May 2009 arrest can proceed with a $2 million lawsuit against Suffolk County, which offered “one erroneous legal principle after another” during a hearing called to consider its retention of the luxury vehicle, a federal judge has ruled.

Eastern District Judge Joanna Seybert, sitting in Central Islip, said that the “neutral magistrate” who presided at the hearing, former Justice John DiNoto, did not correct the “flagrantly illogical presentation” at the hearing by an assistant county attorney.
