The top executive of HSBC Bank USA did not appear at a sanction hearing called by Brooklyn Supreme Court Justice Arthur M. Schack (See Profile) in connection with a foreclosure action he dismissed earlier this month. The judge ordered President and CEO Irene Dorner to appear at Friday’s hearing to take responsibility for the bank’s failure to produce adequate documents.
Marco Cercone of Rupp, Baase, Pfalzgraf, Cunningham & Coppola in Buffalo, who represented HSBC as the trustee, told Justice Schack that Ms. Dorner was out of the country. The judge asked “why is she violating court orders?” Mr. Cerone said she was complying with the order by appearing through counsel. “That’s your opinion,” Justice Schack replied.
