It is ORDERED that this motion by defendant, PETER BACONOVIC (“Baconovic”) for an order staying discovery against Bacanovic pending resolution of certain criminal charges against Bacanovic pending in the United States District Court, Southern District of New York and the cross motion of plaintiff for an order pursuant to CPLR 3124, compelling Bacanovic to appear for a deposition are decided as follows:

Plaintiff, SHELLY WALN (“Waln”) brings this action to recover money damages alleging causes of action against defendants for negligence, conspiracy and fraud, breach of contract, negligent behavior and malpractice, breach of fidiciary duties, corrupt practices and violation of R.I.C.O. and C.O.L.A. statutes. Additionally, plaintiff seeks punitive damages alleging defendants, intentional and gross misconduct.
