In this contentious litigation arising from plaintiff’s post- conviction representation of a criminal defendant who had been represented at trial by defendant Ernest J. Peace, Esq., this Court had scheduled a preliminary conference for 9:30 a.m. on August 13, 2003 in its courtroom in Westchester County. Based upon Peace’s failure to appear, plaintiff was granted a default judgment against him on the issue of liability only, with damages to be assessed at a later time at an inquest.
