The plaintiff, a former sales representative for defendant Vasomedical, Inc. (“Vasomedical”), a manufacturer of health care products, moves for summary judgment in this action, which seeks to recover commissions purportedly due the plaintiff pursuant to his written sales representative agreement, as the result of the purchase of an EECP machine by Cardio Vascular Associates of Virginia (“CVAV”).

The plaintiff ‘s sales representative agreement was executed in May 1999. The sales representative agreement was terminated, either by the plaintiff or Vasomedical, in January 2000. Neither party has offered any documentation supporting their version of how and why the sales representative agreement ended. The only thing clear is that this was a relatively brief relationship which satisfied neither party.
