The plaintiff commenced this action against Bogart’s, a bar/nightclub in Uniondale, and the bar/nightclub’s landlord, seeking $2 million for personal injuries allegedly suffered at the establishment as a result of the defendants’ negligence. The case came on for trial in the early summer of 2003, but was adjourned for 3 months on mutual consent of all parties due to the fact that jurors were on the scheduled trial date unavailable from the Central Jury Part. Immediately following the adjournment the plaintiff served a Supplemental Bill of Particulars.

The Supplemental Bill of Particulars asserts that the defendants violated Alcohol Beverage and Control Law §106(6), which prohibits a “person licensed to sell alcoholic beverages [from permitting] such premises to become disorderly.”
