Judge Stein

United States v. Nature’s Farm Products, Inc. – Defendants Nature’s Farm Products, Inc., Dennis Choi, and Peter Pizzo (collectively, the “NFP defendants”) have moved to transfer this action for the convenience of the parties and witnesses and in the interest of justice pursuant to 28 U.S.C. §1404(a) to the Northern District of California. The NFP defendants have also moved, pursuant to Fed. R. Civ. P. 12(b)(6), to dismiss the government’s second claim alleging that the defendants conspired to defraud the government in violation of the False Claims Act, 31 U.S.C. §3729 et seq. Because, as set forth below, a transfer of this action to the Northern District of California would serve the convenience of the parties and witnesses and the interest of justice within the meaning of 28 U.S.C. §1404(a), the NFP defendants’ motion to transfer this action is granted.
