Apple has filed a trademark infringement complaint against two Flushing, Queens-based stores, Apple Story and Fun Zone, and the stores’ owner, Janice Po Chiang. The case, Apple Inc. v. Apple Story Inc., 03550, was filed in Brooklyn federal district court on July 25, but the papers were sealed until last Thursday (See Complaint).

Apple, which is represented by Mark Mutterperl of Fulbright & Jaworski, alleges the stores sold an assortment of counterfeit iPhone, iPod and iPad cases and stereo headsets bearing Apple trademarks. Two days after the complaint was filed, Eastern District Judge Kiyo Matsumoto authorized a seizure of the accessories. Apple also demands that the defendant be enjoined from using the name Apple Story, arguing in its application for an injunction that the marks are too similar and will result in consumer confusion.
