Supervisors at a state prison should have discovered that a correction officer was having sex with an inmate he got pregnant, a Court of Claims judge has found in holding the state liable for the supervisors’ inattention.

In Perez v. State, 2011 NY Slip Op 21321, Judge Alan C. Marin determined that while the officer who fathered the inmate’s child was adequately trained and the rules and procedures at Bayview Correctional Facility were sufficient, the supervisors should have done more to prevent the repeated encounters.
