A federal judge in Buffalo has held that maritime law trumps New York State General Obligations Law in enforcing a waiver of liability signed by a woman injured while on a whitewater excursion in the lower Niagara River.

Western District Judge John T. Curtin in Brozyna v. Niagara Gorge Jetboating, 10-cv-602-JTC, rejected the plaintiff’s attempt to void her waiver based on a public policy exception in state law. Judge Curtin cited the “long-recognized national interest in the development of a uniform body of maritime law” in granting a defense motion for summary judgment.
