ALBANY – An appeals panel in Albany has revived an insurance claim where a father, preoccupied with caring for a daughter who had been injured in a motorcycle accident, failed to provide timely notice.

The Appellate Division, Third Department, reversed the trial court and gave life to a claim for benefits asserted by William Waldron. The panel said there remains an issue of whether the delay in notice to the insurance company was justified by the circumstances and, if so, the company will have to show it was prejudiced by that delay.
