ESTATE OF J. BRUCE LLEWELLYN, Deceased (1282/10)—In this proceeding for discovery and turnover in the estate of Bruce Llewellyn (SCPA 2103), the preliminary executors seek an order directing two attorneys who previously represented decedent and their law firm to turn over certain property in their possession belonging to decedent. They also seek to depose the two lawyers regarding the identity and location of any other such property.

The property which petitioners seek consists of legal files, documents and records created and/or amassed by the attorneys in their decades-long relationship with decedent. Petitioners allege that respondents drafted three prior wills and numerous trusts for decedent and that one of the attorneys represented decedent in many personal and business matters, as well as participating with decedent in business transactions for his own account. In addition, the attorneys represented decedent’s wife both individually and jointly with decedent. At the call of the calendar, petitioners advised the court that they were not seeking any information regarding the respondents’ representation at the wife alone, or any attorney-client privileged documents regarding a corporation which she now solely owns.
