A postal worker has been indicted for leaving the scene of an accident that resulted in the death of a former longtime court employee. Ian Clement pleaded not guilty at his arraignment last week. He was driving a seven-ton Postal Service truck on July 2, when the vehicle struck Marilyn Dershowitz, who was riding her bicycle on West 29th Street in Manhattan, near Ninth Avenue. Ms. Dershowitz had worked in the courts for more than 20 years and retired as a special referee in Manhattan Supreme Court six months before the accident. She was the wife of Nathan Z. Dershowitz of Dershowitz Eiger & Adelson and sister-in-law of Harvard Law Professor Alan Dershowitz.
In an indictment obtained by the Manhattan District Attorney’s Office, Mr. Clement was charged with leaving the scene of an incident without reporting—resulting in death, a violation of Vehicle and Traffic Law §600(2)(c)(ii). The charge is a D felony, for which defendants with no prior felonies face a maximum sentence of 2 1/3 to 7 years.
