In the two years since a drug law reform measure allowed B felony offenders to seek resentencing, courts have struggled with the practical application of the resentencing provision, as evidenced by recent decisions from the Appellate Division.

Last week, the Second and Third departments both reversed trial courts on resentencing issues in applying the most recent pronouncements from the Court of Appeals as well as the Appellate Division.
